Peer-to-peer lending has been a 'trendy' term for several years now. Some borrowers, having lost faith in banks, are now turning to peer-to-peer lending platforms to apply for credit.
In the United States, peer-to-peer lending has existed since 2006 with the world's first peer-to-peer lending platform: Lending Club. This company, founded by a Frenchman, experienced real success from its launch. Almost ten years later, it claims to have granted more than 4 billion euros in loans.
Private lending is governed in the same way as a 'traditional' loan. This inevitably requires a contract between the borrower and the private lender. This document can take the form of:
Either a loan agreement (form no. 2062, to be signed by the borrower and the lender, each of whom keeps a copy).
Or an acknowledgment of debt (to be drafted, dated, and signed by the borrower; one original for the lender, one for the tax authorities, and one copy for the borrower). For amounts exceeding €1,500, this document must be drawn up by a notary.
This contract must primarily include:
The full names and addresses of both parties;
The loan terms (amount, duration, frequency of monthly repayments, interest rate).
